Let The Debate Begin:texas Man Fatally Shot Burglar And Went Back To Bed Before Calling 911

    Now this will bring up a multitude of personal and legal questions.
    1) Does the home owner have to call 911?
    2) Does the home owner have an responsibility to immediately notify legal authorities?
    3) Is or should the home owner answer the 911 operators questions?

    Lots more questions are sure to be raised. What is your opinion on this article?

    I don't know about Texas law, but here in WV he should have notified authorities after discharging his weapon in self defense by whatever means available to him. Then when the officers failed to show up for a couple hours, he would have been covered.

    As far as question #3. NO, you are not obligated to answer 911's questions, since they can and will be used against you in a court of law. You have NO legal obligation to speak to law enforcement (Most 911 operators are officers of the courts) without legal representation present. You have the right to remain silent....use it.

    If the individual still had the pick axe in his proximity and physical evidence matches his story, he will be found innocent of murder. Sounds like there may be more to the story. Otherwise, I'm not sure why the prosecutor filed murder charges. Unless he's trying to gain political ground for an election.

    If the guy gets a halfway fair judge, he's free. I wonder what TX law is on notifying Law Enforcement on discharging a weapon in self defense? That charge could stick.

    Asked a wanna-be home invader to leave. I had a shotgun. He left. I didn't call 911. Had a sick baby. Clamor woke baby. I itched to kill that drunk felon. Got baby back to sleep. Went to bed. F# it all. Happened centuries ago. Racked buckshot into chamber tonight. Strange car parked near house. Heading to bed.

    Lock n load
    Death doth bode
    Satan's goad
    Lock n load

    No angel doth weep
    Not one peep
    No soul to reap
    Time to sleep

    He's an idiot for not calling immediately to report he had shot at someone, whether or not he knew if he hit them.

    It's also foolish to tamper with the evidence before reporting anything.

    LOL, shoot shovel shut up.

    Seriously though, I would have reported the shooting just to protect myself against criminal bullshit that would be coming. I would call my lawyer first and have him present before calling 911.

      That call to your lawyer is spot-on. Can't raise your lawyer, call/deputize your spouse or good friend to carry-out the mission of getting your lawyer to the police station where your interview and possible booking will occur. If this annoys the cops, then they have issues. Better to spend a night in jail than a decade.

      As to saying nothing. In your mind's theater, hear a cop saying the following, "Yesterday, you told us this and that -- today, you are telling us that and this! Which is it?!" Prosecutors get paid to prosecute. Grand juries are in the pocket of the prosecutors. These people are NOT your friends!

    I wonder what the legalities would be if you had your lawyer call 911 instead of calling yourself. Especially in his case right after the shooting, when he didn't know if he had hit his assailant.

    If the police do not, will not, enforce the law, then do not punish those who are maintaining a civilized society.

    The lives of inferiors/savages have no meaning.

    Point #1: In the case mentioned, there was the possibility of the felon being wounded. Given that situation, there then exists the resultant situation in which the felon might go to, may be taken to, the hospital. Now, what do we now have? We have an aggressive felon in a hospital surrounded by people who are utterly uninformed that this person is not in control of his behavior. Their first thought may be that he is the victim -- he could very well tell them such a fat lie. Trash people always feel sorry for themselves, anyway. Calling the cops would likely have resulted in calls to health care centers to be on alert for gunshot injury. The Beware Alert! going out everywhere would have at the very least caused the hospitals' security to send uniforms to the ER. Uniforms, even if unarmed, still have radios.

    A wounded animal is a dangerous animal.

    Point #2: Shovel? Man, don't hurt your back! Were this a rural situation, there's a lot of back hoes in the county.

    Just like the traditional Japanese societal paradigm, it's best to balance a citizen with both warrior attitude AND the esthetic. Japanese warriors (to include Samurai) were good with the sword, yet also knew the tea ceremony cold. They could arrange flowers and paint fine water colors. Calligraphy, there is a fine discipline. All of my kids got music lessons.

    We humans must know our nature, else fail in life. Thus Socrates advises, "Know thyself."

    Those wishing big government should re-read their history lessons concentrating on the reality of, "power corrupts and absolute power corrupts absolutely". And this is a truth without exception. Our species is deeply flawed. We are NOT fully evolved. For some, the latter is particularly true.

    Arm everyone and have community orchestras.

    SOL, they are extension tubes and can be found at most gun sites. Check your local gun laws and hunting laws, for maximum round count. After the shtf, who cares, load away.

    They really aren't meant to extend beyond the barrel like that.

    They usually will require some modifications to the existing magazine before they will work, and there should be extra barrel bands for support.

    When hunting Federally controlled migratory birds you have to have it plugged so the magazine will only hold 2 shell.

    There's little to NO problems with magazine tubes out past the muzzle of a repeating shotgun. The extension does get dirty w/powder burns, so what. Shot string doesn't expand until way out past the barrel. Shot group inside of a house is basically the size of a fist size ... at best. Indoors, you'd better aim your shotgun like a rifle. Big patterns close-in are the things of movie mythology. I don't care if you have no shot cup, or have sawed off the barrel (losing velocity with that one), or the bore is open choke, ... patterns do NOT open up close-in. Sometimes a FULL choke causes the Largest patterns due to the deformation of the buckshot balls. Crazy-shaped lead doesn't fly straight. Even rifled shotgun barrels do not add spreading to the pattern -- only maybe a toroid WAY out there.

    Those living in urban areas when the mega-rioting begins are going to need to hose-out streams of lead. Only thing on the side of the person trying to survive waves of savages is that the mobs are without courage. Yet, you gotta drop a few to restore any semblance of civilization. Remember the Brits in S.Africa, they went through all of their ammo when the Zulu sent an ocean of soldiers against them (yea, their general split their army into three sections; that was a bit of a suicide maneuver, also). The Zulu shamen told the soldiers that their shields would stop bullets ... IF they had sufficient faith, so those that died were simply faithless. Maybe drugs were involved also. Ask any cop about trying to subdue a "dusted" felon (angel dust / PCP).

    These puppies are front-heavy. During WWII, my dad hated the Thompson sub-gun. Didn't balance right -- especially with drum. Big stick magazines sticking out of the bottom of a weapon reduce how low you can get in prone position. Gotta think about your weapon's user friendliness when the rounds are coming back at you. My dad said that when getting buzz-bombed, "you'd be surprised what a small hole you can curl-up into." My uncle and his mates used his explosives to blow holes into the frozen ground during the Battle of the Bulge to make make-do foxholes. The Germans were using their 88s to send in tree-top burst cannon shells. Half of my uncle's company were killed.

    If the law is not a concern, 12ga flechette rounds , the choice of the day, unless you have them in 37mm or 40mm rounds. Out of a grenade launcher they are AWESOME!

    If someone is shooting at you, you will dig that hole with your hands if that's all you have.

      Full disclosure: The 40mm flechette rounds I used , didn't look like the one pictured. We were also given the choice of 40mm 00 buckshot rounds, which no one preferred.

    I do agree with Snyper on this one. The guy was foolish not to call the authorities immediately, and tampering with evidence at any time is foolish.

    The best advice I ever heard, and fortunately never had to use:
    1.) Give your name, address, and phone number.
    2.) Tell the authorities you are the person who is going to file the complaint.
    3.) Point out any evidence at the scene. In this case maybe the pick axe.
    4.) You will have my complete cooperation within 24 hours AFTER I have spoken with my attorney.

    Don't say another word unless you have your attorney present. PERIOD. END OF STORY. It doesn't matter what you think, or how right you think you are. Keep your mouth shut, and let your attorney do the talking.
